Memorandum to Federal Agency Contacts: New Regulations on Electronic Messages
NARA has updated federal regulations with records management requirements for electronic messages, as directed by the Electronic Messages Preservation Act (EMPA).
To comply with EMPA, NARA has
- added a definition for electronic messages to 36 CFR Chapter 12, Part 1220.18, and
- updated 36 CFR Chapter 12, Part 1222.26 to specifically mention electronic messages.
To help agencies comply with EMPA and the regulations, NARA has issued further guidance for managing electronic messages. NARA expanded the Capstone approach for electronic messages with the new NARA Bulletin 2023-02 and revised GRS 6.1. NARA has also updated its website and created an information resource for “email and electronic messages management”.
