FRC MEMORANDUM TO FEDERAL AGENCY CONTACTS: Policy Change Regarding Inter-Agency Agreements that Cross Fiscal Years

In previous years, if customer agencies entered into inter-agency agreements (IAAs) with the Federal Records Center Program's revolving fund that spanned multiple fiscal years, the customer agencies were required to use funds during the year in which the work was actually performed. For example, for a contract that ran June 1, 2009, through May 31, 2010, an agency could only use FY 2009 funds for the June 1 to September 30 portion of the agreement and FY 2010 funds for the October 1 to May 31 portion.

Based on an opinion recently rendered by NARA's Office of General Counsel, the FRCP and its customers now have more flexibility in funding contracts that cross fiscal years. Agency customers can now either use funds that are obligated during the year in which the work is performed, or they can fund the entire IAA using the first year's funds. Using the same example as above, an agency could use FY 2009 funds for June 1 to September 30 and FY 2010 funds for October 1 to May 31 OR it could elect to fund the entire IAA with FY 2009 funds.

Agency customers of the FRCP who wish to re-obligate all or part of their agency's FY 2009 funding to fund projects that will begin in FY 2009 and carry over into FY 2010 can do so by contacting their local Federal Records Center Director as soon as possible.
